Responsible PERSON
We provide some clarification here between 2 requirements of the regulation often confused. There are requirements for who may be a ‘Safety Assessor’ and who is the ‘Responsible person’.
Safety Assessor
The EU cosmetics regulation lists requirements for the safety assessor such as minimum level of qualifications. It states that the cosmetics safety assessment must be carried out by a person in possession of a diploma or other evidence of formal qualifications awarded on completion of a university course of theoretical and practical study in pharmacy, toxicology, medicine or a similar discipline, from the EU, or a course recognized as equivalent in the EU. Responsible person (RP)
The concept of a RP is that which takes on legal obligations for all aspects of compliance of the regulation. This includes raw material specification, manufacturing processes, labelling, claims, monitoring and resolution of adverse findings. Thus, this is equivalent to a third part having all legal responsibilities across the products lifecycle as transferred to them by written mandate.
Legal Cosmetics® do not believe that it is possible in a cost-effective manner to control all aspects of the supply chain as a regulatory and legal affairs firm and thus do not and cannot act as a responsible person for a cosmetics business with reference to the EU cosmetics regulations.
